ПРАВИЛА И УСЛОВИЯ

1. ОБЩИ ПОЛОЖЕНИЯ

Настоящите Общи условия уреждат използването на онлайн магазина ho-me-so.com, управляван от DIVINE LAB doo. Тези условия са в съответствие със Закона за защита на потребителите (ZVPot), Закона за електронната търговия (ZEPT), Общия регламент за защита на данните (GDPR) и друго приложимо законодателство на Република Словения и Европейския съюз.

2. ЦЕНИ И ДАНЪЦИ

Всички цени са посочени в EUR или местна валута (ако е избрана от посетителя) и включват ДДС, освен ако не е посочено друго. Цените не включват разходи за доставка, мита или допълнителни такси.

Важна забележка:

За доставки извън Европейския съюз клиентът е отговорен за плащането на всички приложими мита, данъци върху вноса и други местни такси. Ако клиентът откаже да плати тези такси:

    • Пакетът ще бъде изпратен за унищожаване без възможност за повторно изпращане.
    • Продавачът не е длъжен да възстанови сумата на покупката.

3. ПРОЦЕС НА ПОРЪЧКА

  1. Placing an Order:On the website, the customer selects the product and clicks on the “buy now” link. The system will redirect you to the shopping cart. If you wish to continue shopping you can do so, but if you wish to complete your purchase, please fill in the billing and shipping details and select your payment method.On the website, in the top right-hand corner, there is a shopping basket icon, which (when clicked) shows the user the products they have added to their shopping basket while browsing the online shop. If the user wishes to remove a product from the shopping basket, he/she must click on the shopping basket icon and on the “remove” cross or, in the case of the “+” sign, increase or decrease the quantity of the products he/she wishes to order by clicking on the “+” or “-” sign.

    A Customer must provide the required contact details marked with a red asterisk (First Name, Last Name, Country/Region, Street address, Postcode/ZIP, Town/City, Phone and Email Address) which we need to confirm and complete your order and to deliver the product.

    A Customer can review the delivery information provided, the payment method chosen and the contents of the shopping cart. If the Customer has chosen to pay by credit card, he/she must enter the credit card details, and if he/she has chosen to pay by PayPal, he/she must complete the purchase via the paypal process. The Customer confirms the order by clicking on the “Pay” button.

  2. Потвърждение на поръчката: Клиентът получава имейл, потвърждаващ поръчката.
  3. Изпращане: Поръчките се изпращат в рамките на 1-3 работни дни след потвърждение.
  4. Начини на плащане:
    • Кредитна карта (чрез Stripe)
    • PayPal
    • Apple Pay
    • Klarna (вноски)
    • Наложен платеж (COD).

5. Delivery: Delivery is carried out by our partners: FedEx, DHL, Packeta, BRT, Pošta Slovenije, DPD. Delivery time depends on the recipient’s location.

Customers can create an account by setting a username and password. The customer’s details are then stored in the user account to facilitate shopping. All data is stored by our Privacy Policy

The delivery period is an indicative period and is not an essential element of the contract. A change in the delivery period shall not be a condition for withdrawal from the contract.

Непотърсени или върнати пакети:

Ако пакетът бъде върнат или не е взет от клиента, продавачът има право:

    • Приспаднете всички такси на доставчика на плащания (напр. PayPal, Stripe) от възстановената сума,
    • Начисляване на допълнителни разходи за обработка и връщане на пакета.

The purchase contract is concluded at the moment of confirmation of the order by the provider (at the moment of receipt of the email “Your order has been accepted!”).

The concluded order/contract is stored electronically by the company. Contracts and invoices are stored in accordance with the law and are available to buyers at the company’s headquarters in case of a forwarded request (a few days before the visit). The customer can request a copy in pdf format via our contact address info@ho-me-so.com.For copies of contracts (invoices, delivery notes) older than two years, the company may charge an issue fee.

We treat accepted orders as irrevocable. The Buyer may cancel the order without any further obligation between the time the order is placed and the time the Buyer receives an e-mail notification that the order is in progress.

4. ПРАВО НА ОТКАЗ ОТ ДОГОВОРА

Customers have the right to withdraw from the contract within 30 days of placing the order, without providing a reason. The withdrawal form is available here.

Условия за теглене:

    • Продуктът трябва да бъде неупотребяван, ненарушен и върнат в оригиналната си опаковка.
    • Клиентът поема разходите за обратна доставка.
    • Трябва да се включи касова бележка или доказателство за покупка.

Процес на възстановяване:

Продавачът ще обработи възстановяването в рамките на 15 дни след получаване на върнатия артикул, намалено с всички приложими такси на доставчика на плащания или разходи за обработка.

5. РЕКЛАМАЦИИ И ГАРАНЦИИ

Клиентите могат да подават оплаквания за:

    • Повредена стока при доставката,
    • Неправилно доставени продукти,
    • Продукти, които не отговарят на тяхното описание или спецификации.

Процедура за рекламация:

Жалбите се подават писмено на info@ho-me-so.com. Продавачът ще разгледа жалбата в рамките на 8 работни дни и ще информира клиента за решението.

Гаранции:

Гаранциите се предоставят в съответствие с приложимите закони. Гаранцията не покрива повреди, причинени от неправилна употреба на продуктите.

6. ЗАЩИТА НА ДАННИТЕ

The seller is committed to protecting customers’ personal data in accordance with GDPR and Slovenian legislation. Collected data is used solely for:

    • Изпълнение на поръчки,
    • Уведомяване на клиентите за статуса на поръчката,
    • Обработване на жалби или запитвания.

7. ОТГОВОРНОСТ НА ПРОДАВАЧА

Продавачът не носи отговорност за:

  • Разходи, произтичащи от неплатени митнически такси,
  • Повреда на продукти след доставка,
  • Неправилна употреба на продукти,
  • Здравословни проблеми или алергични реакции в резултат на съставките на продукта (всички съставки са изброени на уебсайта).

8. ЖАЛБИ И РАЗРЕШАВАНЕ НА СПОРОВЕ

Продавачът спазва всички приложими закони за защита на потребителите и ще се стреми да разрешава всякакви спорове по взаимно съгласие. Жалби могат да се подават до:

The seller hereby informs customers that it does not recognize any alternative dispute resolution (ADR) provider as competent for resolving consumer disputes that a customer may initiate in accordance with the Slovenian Act on Alternative Dispute Resolution for Consumer Disputes.

Ако не бъде постигнато взаимно съгласие, спорът ще бъде разрешен от Окръжния съд на Любляна. За всички сделки се прилага словенското законодателство.

9. LIMITATION OF LIABILITY

Due to the nature of doing business on the Internet, the offer of the online shop changes and is updated quickly and frequently. Despite our best efforts to provide up-to-date and accurate information, the possibility of incorrect price or availability information cannot be excluded. 

In these rare cases, or in cases where the price or delivery status changes during the processing of the order itself, the seller will allow the customer to withdraw from the purchase or offer the best possible solution to the situation

These items may not be copied for commercial use or distribution, nor may they be modified or republished on other sites.This online shop may also contain images for which the provider has obtained the right to use, but which are protected by third-party copyright.

Under no circumstances is the provider responsible for any links that are not part of this online shop or any other websites that are or are not linked to this online shop. The Provider disclaims all responsibility for the accuracy of any information available on these linked sites and any products or services available on these sites.

11. CHANGES TO TERMS AND CONDITIONS

Продавачът си запазва правото да променя настоящите Общи условия. Клиентите ще бъдат уведомявани за промени чрез уебсайта ho-me-so.com. Промените влизат в сила 8 дни след публикуването.
